Terms & Conditions

These Terms and Conditions govern use of Brooke County Busted Mugshots. By using the site, a visitor agrees to them. A visitor who does not accept these terms should not use the site or its search tools.

This privately owned site is not affiliated with a government office, sheriff, jail, or corrections department. Neither the site nor its advertising partners provides services covered by the Fair Credit Reporting Act. It is a public-resource guide for Brooke County and West Virginia, not a private investigation firm or consumer reporting agency.

Nature of the Service

The site is a private guide to official record sources and outside tools. It holds no official custody or court record, cannot confirm a status, release a person, or file paperwork. Its function is to point visitors toward official Brooke County, WVDCR, court, and federal resources.

Pages may also direct a visitor to independently operated research tools. Those providers are separate services with their own terms and policies.

Visitors must use the site lawfully and with respect for other people’s safety and privacy.

  • Do not use the site in violation of any law.
  • Do not stalk, harass, threaten, or harm another person.
  • Do not use content to make employment, housing, lending, insurance, or similar eligibility decisions.
  • Do not seek unauthorized access to the site or linked systems.
  • Do not run automated bots, scrapers, or bulk collection tools.
  • Do not interfere with access by other visitors.

FCRA Limitations

This site is not a consumer reporting agency under the Fair Credit Reporting Act. It does not furnish consumer reports, credit reports, or screening services, and neither it nor its advertising partners offers a product for FCRA-covered decisions. By using the site, you agree not to use information from it or a linked tool for the following purposes.

  • Hiring, firing, or other work decisions.
  • Tenant or housing screening.
  • Creditworthiness or insurance-rate decisions.
  • Licensing, permits, or government-benefit eligibility.
  • Any other decision regulated by the FCRA.

Third-Party Links

The site may link to jail searches, agency pages, court portals, public-record materials, legal resources, and outside search tools. A link does not endorse a destination or make this site responsible for that destination’s content, availability, or handling of data. Review the terms of each external service before using it.

Disclaimers of Warranty

The site is supplied on an “as is” and “as available” basis. It makes no promise concerning:

  • The accuracy, completeness, or currency of information.
  • Uninterrupted access to the site or an outside resource.
  • Freedom from errors, defects, or security problems.
  • The breadth or correctness of results supplied by a partner.

Custody and court information can change quickly. Nothing on this site is an official statement by the Brooke County Sheriff’s Office, WVDCR, a court, or another government body.

Liability Limits

To the fullest extent permitted by law, the site and its operators are not liable for loss or damage arising from use of, inability to use, or reliance on the site or an external resource.

Indemnification

You agree to defend and hold harmless the site, its operators, and its partners from claims, losses, damages, and reasonable legal costs arising from your use of the site or your violation of these terms.

Intellectual Property

The site’s original text, graphics, logo, design, and code belong to Brooke County Busted Mugshots or its content partners. They may not be copied, distributed, modified, or reused without written permission, except where law allows.

Changes to Terms

These terms may be changed at any time. A revised version takes effect when it is posted on this page.

Access Restrictions

Access to all or part of the site may be limited, suspended, or ended at any time, with or without notice, when permitted by law.

West Virginia Law

These terms are governed by the laws of West Virginia. Any dispute must be brought in a court within West Virginia with proper jurisdiction. Public-record requests discussed on this site are directed to the governmental custodian under the applicable West Virginia framework, including W. Va. Code §29B-1-3 where relevant.

Severability

If a court finds one provision invalid or unenforceable, the remaining provisions continue in effect. The affected provision will be adjusted only to the extent necessary to make it enforceable.
